The Martin County Planning Commission/Board of Adjustment will be conducting a public hearing on May 26, 2020 at 5:30 p.m. The hearing will be held in the Martin County Commissioners Room, located on the first floor of the Courthouse, 201 Lake Avenue – Fairmont, MN. The following items will be on the agenda:
Variance Request from Elmer & Shirley Juhl within Section 31 of Fox Lake Township. The Juhls are proposing to build a three-stall garage to be attached onto an existing structure encroaching closer than the minimum required setback from the East sideyard setback in an “SL-2” Shoreland Residential Recreational District on Fox Lake. The Martin County Zoning Ordinance requires a minimum setback of 30 feet from a sideyard setback in an “SL-2” Shoreland Residential Recreational District.
Variance Request from Jeremiah & Alycia Johnson within Section 13 of Center Creek Township. The Johnsons are proposing to build a garage to be attached onto an existing house encroaching closer than the minimum required setback from the centerline of the public right-of-way in an “A” Agricultural District. The Martin County Zoning Ordinance requires a 200 foot setback from the centerline of any public right-of-way for a new building site effective February 17, 2004 and one hundred and thirty (130) feet from the centerline of any public right-of-way for existing building sites constructed before February 17, 2004. Existing building sites cannot further encroach closer than the nearest present building from the centerline of the road provided greater than 130 feet from the centerline in an “A” Agricultural District.

The regular meeting of the Martin County Board of Commissioners was called to order at 9:00 a.m. by Chairman Steve Flohrs. Commissioners present were Elliot Belgard, Kathy Smith, Richard Koons, and Steve Flohrs. Commissioner Mahoney was absent. Also present were Scott Higgins, Martin County Coordinator, Terry Viesselman, County Attorney, Rod Halvorsen, City of Lakes Media, Jason Sorensen, Sentinel Newspaper, Julie Walters, Administrative Assistant, and members of staff and public.
On Motions duly made and adopted the following actions were taken:
Motion by Commissioner Belgard, seconded by Commissioner Koons, to approve the agenda for the March 3, 2020, regular Board of Commissioners meeting. Carried unanimously.
Motion by Commissioner Smith, seconded by Commissioner Belgard, to approve the minutes of the February 18, 2020, regular Board of Commissioners meeting. Carried unanimously.
Motion by Commissioner Belgard, seconded by Commissioner Koons, to approve and authorize the hire of Amanda Heinrichs-Milburn, new Assistant County Attorney, effective March 16, 2020. Carried unanimously.
Motion by Commissioner Belgard, seconded by Commissioner Smith, to accept the resignation of Sue Koons, part time Administrative Assistant for the Martin County Victim Witness Office, effective March 31, 2020. Carried unanimously.
Motion by Commissioner Smith, seconded by Commissioner Belgard, to approve and authorize Board Chair to sign resolution in support of a 17.4 acre land acquisition in Section 15 of Fox Lake Township. Roll Call AYES: Commissioners Koons, Belgard, Smith, and Flohrs. NAYS: None. Commissioner Mahoney was absent.
Motion by Commissioner Belgard, seconded by Commissioner Koons, to approve and authorize Board Chair to sign resolution in support of 19 acre land acquisition in Section 16 of Waverly Township. Roll Call AYES: Commissioners Smith, Koons, Belgard, and Flohrs. NAYS: None. Commissioner Mahoney was absent.
Motion by Commissioner Belgard, seconded by Commissioner Koons, to approve and authorize the purchase of a budgeted 2020 Freightliner 114SD Tandem Axle Dump Truck from Harrison Truck Centers of Mankato, Minnesota, at the state contract price of $115,394.00; and approve and authorize the purchase of a truck box, plow and attachments for the new dump truck from TBEI, Inc., in Lake Crystal, Minnesota, at the state contract price of $108,870.00. Carried unanimously.
Motion by Commissioner Koons, seconded by Commissioner Smith, to approve the purchase of a 2020 Road Groom 11 foot Unit at the state contract price of $15,400.00 from Road Groom Manufacturing in Grundy Center, Iowa. Carried unanimously.
Motion by Commissioner Belgard, seconded by Commissioner Koons, to approve the hire of James Kain as Highway Maintenance Specialist/Parks Coordinator, effective March 9, 2020. Carried unanimously.
Motion by Commissioner Smith, seconded by Commissioner Belgard, to approve and authorize the hire of Derek Laven as Highway Maintenance Specialist, effective on or around March 23, 2020, and is contingent upon required pre-employment drug test; and approve the hire of Tyler Laue as Highway Maintenance Specialist, effective on or around March 23, 2020, and is contingent upon required pre-employment drug test. Carried unanimously.
Motion by Commissioner Belgard, seconded by Commissioner Smith, to approve and authorize the hire of Mercedes Johnson and Lindsey Weber as full time Corrections Officers, effective March 15, 2020; approve and authorize the hire of Maxime Rainville as part time Corrections Officer, effective March 15, 2020; and approve and authorize the hire of Renae Wallace as Transport Officer, effective March 15, 2020. Carried unanimously.
Motion by Commissioner Belgard, seconded by Commissioner Smith, to approve and authorize funding of $102,784.84 as a loan to the Faribault-Martin County Joint Transit Board for payment of the new Elkart Coach Vehicles purchased by the Faribault-Martin County Joint Transit Board; and that 80% of the loaned funds will be reimbursed by the Minnesota Department of Transportation. Carried unanimously.
Motion by Commissioner Smith, seconded by Commissioner Koons, acting as the Drainage Authority for Martin County, set a Public Hearing date of March 17, 2020, at 1:30 p.m. at Hamilton Hall in Blue Earth, Minnesota, for the Proposed Repair on JD #2 M&F. Carried unanimously.
Motion by Commissioner Koons, seconded by Commissioner Smith, acting as the Drainage Authority for Martin County, set a Public Hearing date of April 7, 2020, at 1:30 p.m. in the Commissioners Meeting Room – Martin County Courthouse, for the Proposed Improvement on JD #414 M&F. Carried unanimously.
Motion by Commissioner Belgard, seconded by Commissioner Koons, to approve Warrants, Auditor Warrants, and EFT Transactions to be paid on March 3, 2020, and includes the Martin County Highway Department and Drainage bills as presented. Carried unanimously.

COUNTY COMMISSIONERS COMPENSATION, PER DIEM & EXPENSES
WHEREAS, Chapter 301 of the Session Laws 1975 provides a method for determining County Commissioners’ compensation, per diem pay, and expense allowances, and
WHEREAS, resolution of the County Board establishing the salary, schedule of per diem payments, and expense allowance must be made before January first of each year so as to become effective January first of the next year, and
WHEREAS, the Board of County Commissioners of Martin County after due deliberation and discussion, have determined the annual salary, schedule of per diem payments, and expense allowances that will be effective January 1, 2020, and thereafter, until changed by resolution of the Board in a manner provided by law.
NOW THEREFORE, BE IT RESOLVED, by the Board of County Commissioners of Martin County as follows:
1. That the annual salary of each County Commissioner of Martin County shall be the sum of $25,819.75 plus an additional $1,000 per year for the Chairman; and $500 per year for Vice Chair and/or Commissioners appointed to the Personnel Committee with the exception of the Board Chair, payable bi-weekly, less such deductions as are authorized or required by law, and shall be paid to such Commissioner during such interval as he or she is qualified by law to hold such office.
2. That each individual County Commissioner shall be paid one per diem of $75.00 each day spent in performing the official duties connected with the office. The per diem pay may be paid to any individual County Commissioner making application therefore, who, by proper designation or authorization, has served or is an alternate on any board, committee, or commission of County government, including committees of the Board or for the performance of service for any of the following work, service or activity

The regular meeting of the Martin County Board of Commissioners was called to order at 9:00 a.m. by Chairman Steve Flohrs. Commissioners present were Tom Mahoney, Steve Flohrs, Elliot Belgard, Kathy Smith, and Richard Koons. Motion by Commissioner Smith, seconded by Commissioner Belgard, to approve and authorize recruitment of an additional attorney for the Martin County Attorney’s Office. Carried unanimously.
Motion by Commissioner Belgard, seconded by Commissioner Smith, to approve and authorize Board Chair to sign resolution to acquire nonconservation tax forfeited property to be used for public purpose as a site location for the proposed Martin County Justice Center. Roll Call AYES: Commissioners Koons, Smith, Belgard, and Flohrs. NAYS: None. Commissioner Mahoney was absent.
Motion by Commissioner Belgard, seconded by Commissioner Smith, to approve and authorize Board Chair to sign agreements with MRCI for janitorial services for the Martin County Courthouse/Security Building/Law Enforcement Center and the Human Resource Center, effective February 1, 2020 through January 31, 2021; and reflects a per hour wage rate increase from $9.65 per hour to $10.00 per hour. Carried unanimously.
Motion by Commissioner Koons, seconded by Commissioner Smith, to approve and authorize Board Chair to sign resolution for an Aggregate Resource Mapping Study through the Minnesota Department of Natural Resources to help find gravel deposits around Martin County. Motion by Commissioner Belgard, seconded by Commissioner Koons, to approve Life-Size Veterans Memorial Sculpture Commission Agreement in the amount of $123,000 with Brodin Studios in Kimball, Minnesota to design and construct an original bronze work of art to be installed and displayed at the Martin County Veterans Memorial Site; and approve and authorize the county to issue a $20,000 down payment to commission the artist and that the Martin County Veterans Memorial Committee will reimburse Martin County for the commission down payment; and authorize Martin County Veterans Memorial Committee’s designated representative to sign the Commission Agreement. Motion by Commissioner Belgard, seconded by Commissioner Koons, to approve Life-Size Veterans Memorial Sculpture Commission Agreement in the amount of $123,000 with Brodin Studios in Kimball, Minnesota to design and construct an original bronze work of art to be installed and displayed at the Martin County Veterans Memorial Site; and approve and authorize the county to issue a $20,000 down payment to commission the artist and that the Martin County Veterans Memorial Committee will reimburse Martin County for the commission down payment; and authorize Martin County Veterans Memorial Committee’s designated representative to sign the Commission Agreement. The following items will be on the agenda:
Conditional Use Permit from Mike Bettin, applicant, and Buffalo Lake Leasing, property owner within Section 32 of Rutland Township. Mr. Bettin is proposing to operate a concrete ready-mix plant to be located in an “I” Industrial Zoning District. The Martin County Zoning Ordinance requires a conditional use permit for any concrete plant or any ready-mix plant in an “I” Industrial District.
Conditional Use Permit from Darin & Val Pesta, applicants and property owners, within Section 3 of Nashville Township. The Pestas are proposing to operate a business on an existing building site located in an “A” Agricultural District. The Martin County Ordinance requires a Conditional Use Permit in an “A” Agricultural District for any non-agricultural related retailers and/or businesses on existing farmsteads.
